Terms of Service

These Terms of Service ("Terms") govern your access to and use of Social Director(the "Service"), operated by Altus Entertainment LLC ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Social Director is an AI-assisted social media tool that generates, schedules, and publishes posts to third-party platforms on your behalf. You are responsible for the accounts you connect, the content you publish, and ensuring your use of each connected platform complies with that platform's own terms.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and, if signing up on behalf of an organization, you must have authority to bind it. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Provide accurate information and keep it up to date.

3. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent, deceptive, or harassing purpose;
  • send spam, run influence operations, or impersonate any person or organization;
  • generate or publish content that is illegal, defamatory, hateful, sexually exploitative of minors, or that infringes intellectual property or privacy rights;
  • attempt to probe, scan, reverse engineer, scrape, overload, or otherwise interfere with the Service or its underlying infrastructure;
  • upload malware or use the Service to distribute malicious code;
  • resell, sublicense, or redistribute the Service without our written consent.

4. AI-generated content

The Service uses AI models to draft captions, hashtags, and related content. Outputs may be inaccurate, out of date, or unsuitable for your purpose. You are responsible for reviewing every generated post before it is published, for the prompts and reference material you provide, for confirming you have the rights to any input content (photos, video, brand assets), and for the final published result. Do not rely on AI outputs for legal, medical, financial, or other regulated advice.

As between you and us, you own your input content and the published outputs derived from it, subject to the licenses described below. We may refuse, filter, or remove outputs that violate these Terms or applicable platform rules, and we may suspend accounts that repeatedly generate or publish infringing or prohibited content. 5. Your content

You grant Altus Entertainment LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and transmit your content solely for the purpose of operating, securing, and improving the Service and publishing posts you schedule through it. You represent that you have all rights necessary to grant this license.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Altus Entertainment LLC and its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within the plan you have selected. You may not reverse engineer the Service or circumvent its technical limits.

7. Payments, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, subscription renewals, cancellations, and refund mechanics are governed by Paddle's Checkout Buyer Terms in addition to these Terms.

Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You may cancel at any time through your Paddle customer portal at paddle.net; cancellation takes effect at the end of the current billing period. Refund requests are handled per our Refund Policy.

8. Third-party platforms

The Service connects to third-party social platforms (e.g. Instagram, TikTok, X, Facebook, LinkedIn, YouTube). Those platforms are not operated by us and are governed by their own terms and privacy policies. We are not responsible for their availability, changes to their APIs, or actions they take against your accounts. You authorize us to act on your behalf on connected accounts to the extent needed to provide the Service.

9. Service availability and changes

We work to keep the Service available and reliable, but we do not warrant uninterrupted or error-free operation. We may add, change, or remove features and may temporarily suspend the Service for maintenance, security, or legal reasons.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our acceptable-use rules. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable retention period.

11. Warranties and disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Altus Entertainment LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim or (b) USD $100. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold Altus Entertainment LLC harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service in violation of these Terms or applicable law, or your violation of any third-party rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-product notice. Continued use of the Service after the effective date means you accept the updated Terms.

16. Assignment and force majeure

You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure to perform caused by events beyond its reasonable control.
